The natural inclination of humans toward forms of collective life implies that the significance and meaning of the concept of existence must be interpreted as the development of one's individuality within the community. The family – long regarded as the paradigmatic unit of community – has attracted the attention of those who have sought to analyze the mechanisms of relational life, elevating it to a laboratory for observing, on a smaller scale, the processes and laws of the social macrocosm. More specifically, the notion of center of interest proves to be fundamental in the realization of those expressions – deciphered as various subjective legal situations held by the members of the couple – which enrich the range of intra-family relationships prompted by contemporary social reality. Among these, particular attention is drawn to agreements made in anticipation of marital crises, which have only recently become the subject of study in our legal history, previously discouraged from addressing the topic due to the constant silence of the legislator and the persistent reluctance of the higher courts to recognize their validity. This work – within the framework of a concept of family more aptly oriented toward the development of its members' personalities – aims to offer an alternative evaluation, focusing more closely on the merit of the interests underlying such acts and on the proportionality check regarding their concrete implementation.
La naturale attitudine dell’uomo verso forme di vita aggregata comporta che il rilievo e il significato stesso del concetto di esistenza vadano declinati come sviluppo della propria individualità nella collettività. La famiglia – conside¬rata da lungo tempo come cellula paradigmatica di comunità – ha interessato le opinioni di coloro che si sono adoperati per scomporre i meccanismi della vita di relazione, elevandola a laboratorio per osservare, su scala ridotta, i processi e le leggi del macrocosmo sociale. Piú nello specifico, la nozione di centro d’interesse risulta essere fondamentale nella concretizzazione di quel¬le espressioni – decifrate in altrettante situazioni giuridiche soggettive nella titolarità dei componenti della coppia – che vanno ad arricchire il novero dei rapporti endofamiliari che la realtà sociale contemporanea sollecita. Tra que¬sti, destano particolare interesse gli accordi in previsione della crisi coniugale che sono stati oggetto di studio da parte della letteratura soltanto negli ultimi anni della nostra storia giuridica, tempo piú addietro dissuasa dall’affrontare l’argomento a causa dei costanti silenzi del legislatore e per la tenace ritrosia della giurisprudenza di legittimità nel volerne ammettere la validità. Il pre¬sente lavoro – nel contesto di una concezione di famiglia piú opportunamen¬te orientata allo sviluppo delle personalità dei suoi componenti – si permette di offrire una valutazione alternativa, maggiormente focalizzata sulla valu¬tazione della meritevolezza degli interessi sottesi a tali atti e sul controllo di proporzionalità in merito alla concretezza di questi ultimi.
